Unsafe Premises

Cases involving unsafe premises usually have three factors that must be present and proved. These three factors are that the property owner had an obligation to the victim, that the property owner failed to live up to that obligation, and the victim was injured as a result of this failure. The property owner has a duty to use reasonable care to keep the property area safe from dangerous conditions. Accidents involving unsafe premises can include slip and falls, swimming pools, faulty store displays and inadequate security. Additionally, they can occur in places such as homes, apartment complexes, malls, amusement parks, and other open spaces.
